Terms of Service & Disclaimers
Last updated: August 4, 2026
1. Nature of Service
EarthDesign (the "Platform") is a digital geospatial design, analysis, and visualization service. The Platform synthesizes publicly available remote-sensing data (including USGS LiDAR, USDA SSURGO soil data, and NOAA climatology), proprietary permaculture and agronomic methods, and the user's site geometry into design deliverables.
All Platform outputs are advisory in nature. They are not surveys of record, not certified engineering documents, and not regulatory permits. They do not constitute the practice of land surveying, professional engineering, landscape architecture, or any other licensed profession in any jurisdiction.
2. No Warranty of Fitness
The Platform is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
Remote-sensing and soil data carry inherent uncertainty. Field verification by the user and their licensed contractors is required before any earthworks, plantings, drainage, structural, or other on-the-ground execution.
3. Field Execution Is the Client's Responsibility
Site execution — including but not limited to excavation, swale and pond construction, contouring, drainage, planting, irrigation, and any work involving heavy equipment — remains the sole responsibility of the client and their licensed contractors. The client is responsible for:
- All required municipal, county, state, and federal permits.
- Locating and protecting buried utilities (call 811 before digging).
- Compliance with wetlands, riparian, endangered species, and historic preservation rules.
- OSHA-compliant safety practices on site.
- Verification of Platform-derived geometry against on-the-ground reality before construction.
4. Regulatory Compliance
Nothing in the Platform substitutes for licensed professional judgement where required by law. For any project requiring a licensed engineer's stamp, a surveyor's plat, a landscape architect's signature, or any equivalent professional sign-off, the client must retain the appropriate licensed professional.
5. Coverage Scope
Service quality depends on the terrain and soil data available for your site. Current coverage:
- United States — full. Nationwide; backed by the authoritative USDA national soil database.
- England — full. Effectively nationwide.
- Wales — full. Effectively nationwide.
- Netherlands — full. Nationwide.
- Switzerland — full. Nationwide.
- Scotland — partial. Outer Hebrides only — not mainland.
- France — partial. National rollout in progress — not yet complete.
- New Zealand — partial. Extensive, not yet fully complete.
- Spain — partial. Mainland + Balearics + Canaries — coarser resolution.
In the United States, soil types and properties (drainage class, erodibility, infiltration) come from the authoritative USDA national soil database. Elsewhere they are modeled from a global soil dataset — a derived product rather than boots-on-the-ground measurement. Spanish terrain is at a noticeably coarser resolution.
If, after purchase, we determine your site lacks the data quality a deliverable requires, we will tell you before doing the work and offer a full refund of the affected step or a rescope.
6. Pricing & Payments
Design steps (Foundation, Water Story, Earthworks Plan, and Regenerative Master Plan) are priced by acreage band, published on the storefront. The price shown at checkout is the price you pay — payment is captured in full at checkout and work begins immediately. Every paid step includes a virtual session (Google Meet) that you schedule after payment; the Living Master Plan includes two separate one-hour sessions.
Credit-forward: 100% of what you paid for your previous step credits toward the next step for 12 months from purchase.
Application-routed work: large-acreage Regenerative Master Plans and sites over 1,000 acres are not sold directly. You submit a short application; if we accept, you receive an acceptance email with a payment link for a 50% deposit, and the remaining 50% is due when the plan is delivered. No payment is captured with the application itself.
Soil Health Audit: optional at any point and never required to advance a design step. It is priced per management zone as derived from your land (minimum 3 zones); a trimmed panel option is available at a lower per-zone rate. Zone counts shown before purchase are estimates; the billed count comes from your site's actual zone map. The optional loaner instrument case carries a flat kit fee plus a $500 refundable hardware deposit, returned in full when the kit is returned; you may instead keep the kit for the published keep-the-kit price.
7. Refunds & Cancellations
- Before work product is delivered: you may cancel a design step for a full refund any time before your draft deliverable is issued.
- Data shortfall: if your site turns out to lack the required LiDAR or soil data, the affected step is fully refunded or rescoped at your choice (§5).
- Application deposits: the 50% acceptance deposit is refundable until fieldwork or design work begins; the delivery balance is only charged when your plan is delivered.
- Soil audit kits: the $500 hardware deposit is refunded in full on return of the complete kit in working order. Lab fees are non-refundable once samples ship to the lab.
8. Data & Privacy
Site coordinates, boundary geometry, soil sample metadata, and project files submitted to the Platform are stored to fulfill the engagement and are not shared with third parties except as required by law or as necessary to deliver the engagement (e.g., shipping a kit to the address provided, or sending soil samples to the partner lab).
The free Site Snapshot requires a free account to view its result. The email address on that account, together with the location and boundary you submit, is stored so we can keep your snapshot with your account and follow up about your site. You can ask us to delete it at any time via the contact channel below.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Platform's aggregate liability for any claim arising out of or related to the Platform is limited to the fees actually paid by the client for the specific deliverable giving rise to the claim. In no event shall the Platform be liable for indirect, incidental, consequential, special, or punitive damages.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.
11. Contact
For questions about these Terms, contact us through the contact channel published on the Platform.
